Terms of Use

Welcome to Indiadel. This document is an electronic record in terms of Information Technology Act, 2000 and published in accordance with the provisions of Rule 3 ) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of platform - www.indiadel.com (hereinafter referred to as Indiadel).

Indiadel specializes in providing top-notch package forwarding services from India to destinations worldwide. We cater to international shoppers, no matter where they are located, enabling them to shop from any Indian retailer with ease.

This User Agreement ("Agreement") is a legally binding agreement between the user (referred to as ‘User’, ‘Recipient’, ‘You’, ‘Member’, And ‘Your’) and www.Indiadel.com  ( referred to as ‘Indiadel’, ‘We’, ‘Us’, or ‘Our’)  owned and operated by Indiadel, a Sole Proprietary registered in India having its registered office at XIII/211E, Pariyanickal Building, Kuravilangad P.O, Kottayam, Kerala, PIN -686633 and its branch office at XXIII/388,387,  Ward No.23,Arunapuram P.O, Pala Municipality, Kottayam, Kerala PIN : 686574.

When You use any of the services provided by Us through our website,www.indiadel.com, you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use. We reserve the right, at Our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior written notice to you. You shall ensure to review these Terms of Use periodically for updates/changes. Your continued use of the website following the posting of changes will mean that you accept and agree to the revisions. As long as you comply with these Terms of Use, We grant you a personal, non-exclusive, non-transferable, limited privilege to enter and use the website, indiadel. By impliedly or expressly accepting these Terms of Use, you also accept and agree to be bound by Indiadel Policies including but not limited to Privacy Policy as amended from time to time.

1.User Account, Password, and Security

To use our website, you have to register first using your personal information. You are responsible for maintaining the confidentiality of your Display Name and Password. All activities occurring under your Display Name and Password are your responsibility. If the information provided by you is untrue, inaccurate, outdated, or incomplete, we reserve the right to suspend, terminate, or block your access to the platform indefinitely. If we suspect a breach of security or misuse of your account, we may request a password change or temporarily suspend your account without liability. Indiadel shall not be liable for any loss arising from your failure to secure your account credentials. If a single device is associated with multiple logins or sign-ups, we may moderate users and their devices to enhance security and privacy, safeguarding sensitive information. Your mobile phone number and e mail address are the primary identifier for your account. It is your responsibility to ensure your phone number and email address are up to date. If your contact information changes, you must update it promptly on the platform through OTP verification. Indiadel will not be responsible for misuse of your account due to failure to update contact details or maintain account security. Notify us immediately of any unauthorized access or breach of your account. If you allow others to access your account (e.g., through separate profiles), you are fully liable for all actions and their consequences. If you do not access the platform for two years, your data, including transactional data, will be deleted from our records, and you will no longer have access to it.

The trademarks, logos, and service marks displayed on this website, including but not limited to the trademarks "Indiadel" and "www.indiadel.com”" are the property of Indiadel. Other company names, product names, and service logos featured on the website may belong to their respective owners, who may or may not be affiliated with, endorsed by, or connected to us. Nothing on this website shall be interpreted as granting, either by implication or otherwise, any license or right to use any trademarks or service marks shown here without obtaining our prior written permission in each instance.

Additionally, the content on this website is protected under copyright law and is also copyrighted as a collective work under The Copyright Act, 1957. Unauthorized  is prohibited and Indiadel retains ownership of the copyright concerning the selection, coordination, arrangement, and enhancement of this content.

By using the Indiadel website and services, you agree to adhere to the following guidelines. You acknowledge that violation of these guidelines may result in the suspension or termination of your account and/or access to our services.

3.Prohibited Uses

You agree not to use the Indiadel website or services to:

  1. Infringe on Intellectual Property Rights
    • Disseminate or transmit any content that infringes or violates another party’s copyright, trademark, trade secret, patent, or other intellectual property rights.
  1. Violate Laws
    • Engage in any activity that violates local, state, national, or international laws, whether intentionally or unintentionally.
  1. Harm the Platform or Users
    • Harm or threaten to harm Indiadel, its users, or its operations, including using information obtained from Indiadel to compete against the platform.
  1. Impersonation
    • Impersonate any individual or entity, including Indiadel or its agents, or misrepresent your affiliation with a person or organization.
  1. Identity Manipulation
    • Forge Internet protocol (IP) headers or manipulate identifying information to disguise your identity or activities.
  1. Provide Fraudulent Information
    • Submit false, inaccurate, or incomplete information to Indiadel, any shipping service provider, or government agencies.
  1. Disrupt Operations
    • Interfere with or disrupt the services, the website, servers, or networks connected to the website, or disobey network rules, procedures, policies, or regulations.
  1. Infringe on Privacy
    • Violate others' personal privacy rights, including collecting or distributing personal information about users without their consent, except as permitted by law.
  1. Data Collection
    • Collect or store personal data about other users without proper authorization.
  1. Malware or Harmful Content
    • Upload or post material containing software viruses, malware, or any other harmful computer code, files, or programs designed to interrupt, destroy, or limit the functionality of software, hardware, or telecommunication equipment.

4. Oversized Packages Policy

Oversized packages refer to parcels that exceed the weight or dimension limits established by the designated carrier. Such packages are subject to specific handling protocols to ensure compliance with shipping regulations.

  • Maximum Weight: No single package should exceed 30 kg.
  • Maximum Dimensions: Packages must not exceed 100 cm x 80 cm x 80 cm in size.

Handling of Oversized Packages

  1. Dividing or Reducing:
    • Packages exceeding the weight or size limits may need to be divided or reduced into smaller shipments to meet the carrier's requirements.
  1. Disposal or Return:
    • If the package cannot be adjusted to comply with the carrier’s limits, it may be:
      • Returned to the sender.
      • Disposed of, subject to the agreement between the sender and the service provider.
  1. Customer Responsibility:
    • Customers are responsible for ensuring their packages meet the carrier's specified size and weight limits before shipping.
    • Any additional costs incurred for dividing, reducing, or returning oversized packages will be the responsibility of the sender.

5. Abandoned/Unclaimed Packages Policy

Indiadel reserves the right to dispose of any abandoned or unclaimed packages under the following conditions:

  1. Definition of Abandoned/Unclaimed Packages:
    • A package is deemed abandoned or unclaimed if it remains at Indiadel facility beyond the specified storage period and no action is taken by the customer to claim or redirect it.
  2. Storage Period:
    • Packages will be stored for a standard period of 30 days of free storage unless extended storage fees are paid.
    • After the storage period, Indiadel will attempt to contact the customer through the registered email or phone number.
  3. Notification Process:
    • Indiadel will issue notifications reminding the customer to take action on the package (e.g., ship, consolidate, or return).
    • If no response or payment is received after 3 reminders, the package will be considered abandoned.
  4. Disposal of Abandoned Packages:
    • Indiadel will dispose of the abandoned package in a manner deemed appropriate, which may include recycling, donation, or discarding.
    • Customers will forfeit any claims or refunds associated with abandoned packages.
  5. Liability Disclaimer:
    • Indiadel is not liable for any loss or damage resulting from the disposal of abandoned or unclaimed packages.
    • It is the customer's responsibility to track and take timely action on their shipments.
  6. Prevention Measures:
    • Customers are encouraged to regularly check their account status and respond promptly to notifications regarding their packages.
    • Extended storage options are available upon request for a fee to avoid abandonment.
  1. Documentation Policy

 Proper and accurate documentation is required to ensure compliance with international trade regulations and customs requirements while facilitating efficient and accurate processing of shipments.

Customers must provide the following documents when shipping packages internationally:

  • Commercial Invoice: A detailed list of the items being shipped, including descriptions, quantities, and declared value.
  • Packing List: A breakdown of the contents of the package for inventory and customs purposes (optional in some cases).
  • Government-Issued Identification: Required for sender verification, such as a passport, Aadhaar, or driver's license (as per local laws).
  • Export Declaration Forms (if applicable): For certain high-value shipments or restricted items, export declarations may be mandatory.
  • Special Licenses or Permits (if applicable): For controlled or restricted items (e.g., electronics, medicines, or perishables).
  • Power of Attorney: If a third-party courier or customs broker is involved in processing the shipment.

 It is the Customer’s responsibility to provide accurate and complete information on the contents and value of the shipment, ensure compliance with export/import regulations in both the sending and receiving countries and pay any applicable customs duties, taxes, and clearance fees.

  1. Customs Duties
  • The recipient (consignee) is responsible for paying all applicable customs duties, taxes, and fees imposed by the destination country’s customs authority.

If customs duties are not paid by the consignee within a specified time, the package may be:

  • Returned to the sender.
  • Held in customs until payment is received.
  • Disposed of by customs if unclaimed.

  Additional Charges: Storage fees or penalties may be imposed for delays in customs clearance.

  • It is the responsibility of the customer to pay any charges related to the return, holding and disposal of the parcel in relation to the customs duty.
  1. Excluded Countries:

Afghanistan, Cuba,  Iraq, Libya, Mali, Niger, Sudan, Syria and Yemen, Central African Republic, Iran, Iraq, North Korea, Libya, Somalia, Syria, Democratic Republic of Congo

  1. Force Majeure Policy

In the event of a Force Majeure, indiadel will make reasonable efforts to notify affected parties and resume operations as soon as practicable. However, indiadel disclaims liability for any damages, costs, or losses incurred due to such events. Indiadel shall not be held liable or responsible for any delay, disruption, or failure in the performance of its obligations under this agreement caused by events or circumstances beyond its reasonable control. Such events include, but are not limited to:

  1. Acts of God: Natural disasters such as earthquakes, hurricanes, floods, or other extreme weather conditions.
  2. War and Civil Disturbances: Acts of war, military actions, terrorism, riots, or civil unrest.
  3. Transportation Disruptions: Interruptions in shipping, logistics, or transportation networks due to strikes, blockades, or other unforeseen events.
  4. Labor Strikes: Work stoppages or labor disputes involving third-party vendors or service providers.
  5. Technological Failures: Failures or breaches in telecommunications, internet infrastructure, information services, or systems due to hacking, spam, or other cyber threats.
  6. Vendor or Supplier Failures: Acts or omissions of vendors, suppliers, or partners that are beyond the control of Indiadel.
  7. Government Actions: Regulatory changes, sanctions, or other governmental interventions that impact the provision of services.

 

 

  1. Indemnification Policy

You agree to indemnify, defend, and hold Us, Our affiliates, officers, directors, employees, agents, and representatives harmless from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney’s fees) arising out of or in connection with:

  • Any breach of this Agreement, including but not limited to false or incomplete information provided by You.
  • Your violation of any applicable laws, regulations, or third-party rights (including intellectual property rights) in connection with the use of Our services.
  • Any claims related to the contents of Your package(s), including but not limited to prohibited, illegal, or restricted items.
  • Failure to comply with customs regulations, resulting in fines, penalties, or confiscation of goods.
  • Your negligence or intentional misconduct.

You shall indemnify Us for any claims made by third parties arising from:

  • The improper packaging of items.
  • The shipment of prohibited or restricted goods.
  • The failure to declare items truthfully, accurately, or completely.

You agree to indemnify Us for any penalties, fines, or other liabilities imposed by customs or regulatory authorities due to:

  • Incorrect, incomplete, or fraudulent documentation provided by You.
  • Misdeclaration of goods, including value, contents, or classification.

You indemnify Us against any claims or liabilities arising from unauthorized use of Our services, accounts, or systems by You or any party acting on Your behalf.

Our liability is limited as per the terms of the Service Agreement. In no event shall we be liable for indirect, incidental, or consequential damages arising from the use of Our services.

You agree to cooperate with Us in the defense of any claims or legal actions brought against Us, including providing documentation and information necessary for resolution.

This indemnification policy applies to all shipments and services provided by Us. The obligations under this policy will survive the termination or cessation of Your relationship with Us.

This Indemnification Policy shall be governed by and construed in accordance with the laws of Indian Jurisdiction. Any disputes arising under this policy will be resolved exclusively in the courts of Kerala.
